Terms and Conditions

This Vacation Rental Agreement is entered into as of the date of booking confirmation between the Property Manager, Neptune Stays Ltd, and the Guest, for the rental of the property listed with Neptune Stays Ltd at staysbyneptune.com.

Property Details

The property address, amenities, and house rules are as detailed in the relevant listing. The Guest acknowledges receipt of all property information and agrees to comply with all stated requirements.

Rental Period & Check-In / Check-Out

Check-in time is 15:00 hours (3:00 PM). Check-out time is 11:00 hours (11:00 AM) on the departure date, unless otherwise agreed in writing. Early check-in or late check-out requests may be accommodated at the Owner's discretion, subject to an additional fee of 50% of the nightly rate per each partial day. The Guest must vacate the property promptly at the scheduled check-out time. Failure to do so will incur additional charges at EUR 100 per hour or part thereof.

Payment Terms

The Guest agrees to pay 100% of the total rental amount at the time of booking. No booking is confirmed until full payment is received. All payments shall be processed through the payment gateway presented at the time of booking. The Owner shall not accept direct payments or alternative payment methods without prior written authorisation. Payment includes the nightly rental rate and applicable taxes as displayed in the booking summary. All currency amounts are expressed in Euro (€) unless otherwise stated.

Mauritius Tourism Tax

In accordance with Mauritius tourism regulations, a Tourism Tax is levied on all accommodation. The Guest shall pay EUR €3.00 per guest aged 12 years and above per night to the Owner. This Tourism Tax must be paid in full upon arrival at check-in. Payment shall be made in cash or by card as accepted by the Owner. No booking is considered complete until this tax is settled. The Tourism Tax is calculated as follows: EUR €3.00 × number of eligible guests × number of nights of stay. Children under 12 years of age are exempt from this tax. The Guest acknowledges that this tax is a statutory obligation imposed by the Mauritius Tourism Authority and is non-negotiable. The Owner is obligated to collect and remit this tax to the relevant Mauritian authorities as per legal requirements.

Refundable Security / Damage Deposit

A refundable security deposit is required as collateral against damage, loss, or other charges. The deposit amount and collection method will be communicated to the Guest separately via a secure damage deposit link prior to or at the time of check-in. The deposit is held for up to 30 days following check-out to assess the property condition. The Owner reserves the right to claim against the deposit for damage to the property or furnishings beyond normal wear and tear, loss or theft of property items, excessive cleaning costs or trash removal, violations of house rules, additional utility costs, or any other damages attributable to the Guest. Any deductions from the security deposit will be documented and communicated to the Guest within 30 days of check-out. The remaining balance shall be released through the deposit platform used. If damage is discovered after the 30-day hold period, the Owner may pursue additional claims against the Guest directly.

Cancellation Policy

The Guest may cancel this booking subject to the following refund schedule, calculated from the date written cancellation notice is received by the Property Manager (via email or the original booking channel) relative to the check-in date:

The full rental amount is payable at the time of booking, as set out in the Payment Terms above. Cancellation does not release the Guest from this payment obligation except as provided in the refund schedule above.

The Owner may, at its sole discretion, waive or modify this schedule in cases of documented emergency (medical incident, bereavement, or similar), but is under no obligation to do so.

The Guest is strongly advised to purchase travel insurance to cover cancellation for unforeseen circumstances, as sums forfeited under this policy are not recoverable from the Owner.

Cancellations must be made in writing to the Owner or through the original booking channel. This cancellation policy takes precedence over any general refund terms displayed elsewhere; where a specific policy is stated in the booking summary for a given rate or promotion, that specific policy applies instead.

Guest Responsibilities & House Rules

The Guest agrees to occupy the property with no more than the maximum number of guests specified at the time of booking, and not to permit unauthorised visitors or sub-lease the property to third parties without written consent from the Owner. The Guest shall maintain the property in a clean and hygienic condition throughout the stay, and shall not conduct any commercial activities, events, parties, or gatherings beyond the scope of normal residential occupation. The Guest agrees to comply with all local laws, regulations, and noise ordinances. Quiet hours apply from 22:00 to 08:00 daily. The Guest shall not smoke, vape, or use illegal substances anywhere within the property or grounds, and shall not bring pets unless explicitly authorised in writing. The Guest shall not remove, damage, or tamper with any property fixtures, amenities, safety equipment, or surveillance equipment, and shall use all appliances and facilities in accordance with the manufacturer's instructions and the Owner's guidelines. All keys, access cards, and property items must be returned upon check-out.

Liability for Damage

The Guest is fully liable for any damage to the property, furnishings, appliances, or grounds caused by the Guest or their visitors during the rental period, including damage resulting from misuse, negligence, or violation of house rules. Normal wear and tear is not considered damage. However, intentional damage, excessive stains, breakage, or loss of items shall be charged at the full replacement or repair cost. The Owner shall provide photographic evidence of damage and repair quotations. The Guest has seven (7) days to dispute any damage claims with supporting evidence. Damage charges exceeding the security deposit shall be billed to the Guest's payment method on file. The Guest agrees to pay such charges within 14 days of invoice.

Cleaning & Maintenance

The Guest is expected to leave the property in the same clean condition as found. Basic tidying including dishes, floors, and surfaces is the Guest's responsibility. The Owner shall conduct a professional cleaning between guests. If excessive cleaning is required due to the Guest's neglect, additional cleaning charges of EUR €50 to €200 may be deducted from the security deposit. The Guest shall report any maintenance issues, broken appliances, or malfunctions immediately to the Owner and shall not attempt repairs themselves.

Insurance & Indemnification

The Owner maintains property insurance. However, this insurance does not cover the Guest's personal belongings or liability for damages caused by the Guest. The Guest is strongly advised to obtain travel and personal liability insurance to cover their belongings and personal liability during the rental period. The Guest agrees to indemnify, defend, and hold harmless the Owner from any third-party claims, lawsuits, or liabilities arising from the Guest's actions, negligence, or violations of this Agreement.

Privacy & Security Measures

The property may contain security cameras in outdoor areas for security purposes. The Guest acknowledges this and consents to recorded footage. The Owner respects Guest privacy and shall not access the property during the rental period unless there is an emergency, maintenance is required, the property is abandoned, or as permitted by local law. Notice shall be provided when possible. Guest personal data is collected and processed in accordance with applicable data protection laws.

Emergency Procedures

In case of emergency including fire, flood, or medical situations, the Guest shall immediately contact emergency services and notify the Owner. The property contains fire extinguishers, first aid kits, and emergency contact information. The Guest is responsible for familiarising themselves with emergency exits and procedures upon arrival.

Dispute Resolution & Complaints

Any complaints regarding the property, condition, or service must be reported to the Owner in writing within 24 hours of occurrence. The Owner shall investigate complaints in good faith and respond within 48 hours. Disputes shall initially be resolved through good faith negotiation between the parties. If amicable resolution is not reached, disputes shall be governed by the laws of the Republic of Mauritius and subject to the jurisdiction of the Mauritius courts.

Right to Early Termination

The Owner reserves the right to terminate this Agreement immediately and require the Guest to vacate if the Guest violates house rules or this Agreement, the property is significantly damaged, the Guest engages in illegal activities, the Guest is disruptive, threatening, or abusive, or the property becomes unsafe or uninhabitable. In such cases, the Guest shall not be entitled to a refund beyond deductions for damage and applicable fees.

Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Republic of Mauritius. Both parties submit to the exclusive jurisdiction of the Mauritius courts for any disputes.

Acknowledgment & Acceptance

By completing a booking through Neptune Stays Ltd or any connected booking channel, the Guest acknowledges that they have read, understood, and agree to be bound by all terms and conditions of this Vacation Rental Agreement, including the Cancellation Policy set out above. The Guest confirms they have the authority to enter into this Agreement and that all information provided is accurate and truthful. This Agreement is effective from the date of booking confirmation.
